Article 2 — Description of the service
GetUnseen is a mobile app offering a digital take on film photography. The user buys a virtual film roll (12, 24 or 36 shots) and takes photos from within the app. The photos cannot be viewed before the end of the film roll.
A physical 10×15 cm print of every photo is included with every solo film roll, sent to an address in mainland France. Photos are taken and printed in the 2:3 format, that of the 10×15 cm print.
Event mode lets a host open a shared film roll with their participants by means of an invitation code. The event plan includes the physical 10×15 cm print of every photo actually taken during the event, up to the number of shots of the plan purchased, sent in a single shipment to the address given by the host after the event is closed.
Paid options are available: extra copies, additional recipients and reprints, for as long as the photos are kept (article 7).
Article 3 — Prices and payment
The applicable prices are those displayed in the app at the time of the order. They are expressed in euros, all taxes included (VAT not applicable, article 293 B of the French General Tax Code), and include printing and delivery in mainland France of the first copy.
Payment is made online by bank card through Stripe. The order is confirmed as soon as payment is received, and an invoice is sent by e-mail. No bank details are kept by GetUnseen.
Article 4 — Right of withdrawal
In accordance with article L221-18 of the French Consumer Code, the customer has 14 days from the date of purchase to exercise their right of withdrawal, without having to give a reason or bear any penalty.
Statutory exception: Pursuant to article L221-28 (12°), the right of withdrawal cannot be exercised for services fully performed before the end of the withdrawal period. As soon as the first photo is taken, the service is deemed to be in the course of performance and withdrawal no longer applies.
Article 5 — Refund terms
Refunds are made through Stripe to the original means of payment, within 5 to 10 business days depending on the bank. The request can be made from the app or by e-mail. GetUnseen reserves the right to check that the request is well founded before processing it and undertakes to reply within 48 business hours.
Article 6 — Printing and delivery
The prints are made by our partner Cloudprinter.com B.V. (the Netherlands), in a workshop located in the European Union, then sent by carrier to the address given, in mainland France only. The indicative lead time is 5 to 10 business days after the order has been processed. No customs duties are payable.
A telephone number is requested for each delivery address: it is passed on to the printer and the carrier, who require it, solely for the delivery of the parcel.
Should the prints be lost or damaged in transit, GetUnseen undertakes to reprint and resend them free of charge on presentation of proof (photo of the damaged parcel or prints).
Article 7 — Photos: ownership and retention
The user keeps all intellectual property rights over the photos taken through the app. GetUnseen does not use, reproduce or commercialise its users' photos, and passes them on only to the printer, solely to produce the prints ordered.
The photos of a solo film roll are accessible to their author only. Photos taken during an event are accessible to the event host, who orders their printing.
Photos are kept for 90 days after delivery of the order, then deleted automatically; an e-mail warns the user 7 days beforehand. After that period, no reprint is possible. The customer can download their photos and save them on their device before they are deleted.
Article 8 — Personal data and GDPR
Personal data is processed in accordance with the General Data Protection Regulation (GDPR — EU 2016/679). Details of the data collected, its purposes, its retention periods and the processors are set out in the privacy policy.
No data is sold or passed on to third parties for commercial purposes. Rights of access, rectification, erasure and portability: hello@getunseen.app.
Article 9 — Limitation of liability
GetUnseen cannot be held liable for damage resulting from a malfunction of the user's device, a loss of Internet connectivity, or an event of force majeure. GetUnseen's liability is limited to the total amount of the order concerned.

Should a dispute not be settled amicably, the consumer may refer the matter free of charge to a consumer mediator (directive 2013/11/EU). As a last resort, the competent court is that of Nantes (Loire-Atlantique, France).
